Subjects enrolled in studies testing high risk interventions for incurable or progressive brain diseases may be vulnerable to deficiencies in informed consent, such as the therapeutic misconception. However, the definition and measurement of the therapeutic misconception is a subject of continuing debate. Our qualitative pilot study of persons enrolled in a phase I trial of gene transfer for Parkinson disease suggests potential avenues for both measuring and preventing the therapeutic misconception. Building on earlier literature on the topic, we developed (...) and tested an interview guide that focuses on how the subjects decided to participate, emphasizing the integration of subjects’ various statements that are relevant to assessing the therapeutic misconception, rather than evaluating them as isolated statements. The results indicate that a subject’s understanding of the purpose of research is best explored in juxtaposition to the subject’s motivation for participating. (shrink)

Human culture is uniquely complex compared to other species. This complexity stems from the accumulation of culture over time through high- and low-fidelity transmission and innovation. One possible reason for why humans retain and create culture, is our ability to modulate teaching strategies in order to foster learning and innovation. We argue that teaching is more diverse, flexible, and complex in humans than in other species. This particular characteristic of human teaching rather than teaching itself is one of the reasons (...) for human’s incredible capacity for cumulative culture. That is, humans unlike other species can signal to learners whether the information they are teaching can or cannot be modified. As a result teaching in humans can be used to support high or low fidelity transmission, innovation, and ultimately, cumulative culture. (shrink)

Bioethicists have long been concerned that seriously ill patients entering early phase (‘phase I’) treatment trials are motivated by therapeutic benefit even though the likelihood of benefit is low. In spite of these concerns, consent forms for phase I studies involving seriously ill patients generally employ indeterminate benefit statements rather than unambiguous statements of unlikely benefit. This seeming mismatch between attitudes and actions suggests a need to better understand research ethics committee members’ attitudes toward communication of potential benefits and risks (...) of early phase studies to potential subjects. We surveyed the members of two U.S. research ethics committees using a phase I gene transfer study scenario, and compared the results to a previous survey of potential subjects’ perceptions and attitudes toward benefit and risk for the same protocol. The results show that there is indeed a gap between the subjects’ perceptions and the committee members’ views on what is appropriate to be communicated to research subjects. This discrepancy is the product of both the commonly assumed optimism of the subjects and to a “protective pessimism” of the research ethics committee members. We discuss this discrepancy using “frameworks of trust” and demonstrate the need to incorporate these frameworks into the existing model of informed consent. (shrink)

This paper argues against the thesis of Professor Savan, that Spinoza's views about words and about the imagination are such that he could not consistently say, and indeed did not think, that philosophical truths can be expressed adequately in language. The evidence for this thesis is examined in detail, and it is argued that Spinoza should have distinguished between two types of imagination, corresponding roughly to Kant's transcendental and empirical imagination. Finally, it is suggested that the bulk of the argument (...) of the Ethics is conducted on the level of the ?second kind of knowledge?, reason, but that it also contains examples of the use of the first and third kinds of knowledge. ABSTRACT This article contrasts Francis Bacon’s understanding of civil war, sedition, and rebellion with that of his near contemporaries and predecessors, especially Montaigne, Bodin, Machiavelli, Alberico Gentili and Edward Forset. The article contends that for Bacon, civil war, sedition, and rebellion are the antitheses of good government and that which prudent policy aims to avoid. The article further argues that for Bacon as sedition and its extremities are caused by poverty and discontentment, and these, in Bacon’s view, are the result (...) of overpopulation or ‘surcharge of people’, Bacon’s view for the avoidance of civil war aims at policies of outward expansion in the form of colonies and wars of aggression, both of which aim to reduce the metropole’s own population and therewith its propensity to civil war. The article argues that a consideration of Bacon on civil war in particular will shed considerable light on the ideological origins of the British Empire which have often been ignored – where some contemporary political theorists and historians are keen to link ideologies of empire to corresponding positions in political anthropology. A consideration of Bacon’s thought on civil war will show, instead, the article contends, that for key ideological originators of imperial justifications, imperial projects have their origin in domestic politics and the avoidance of civil war. The concept of freedom is one which Hegel thought of very great importance; indeed, he believed that it is the central concept in human history. ‘Mind is free’, he wrote, ‘and to actualise this, its essence – to achieve this excellence – is the endeavour of the worldmind in world-history’. Those who already have an interest in Hegel will doubtless be interested in his views on a topic which he thought so important; on the other hand, the many philosophers who (...) are either indifferent to or hostile to Hegel may point out that it does not follow that, because the subject of freedom interested Hegel, his views about this subject are of general interest. It will be the aim of this paper to show that they are of general interest; in the meantime, it may be recalled that Isaiah Berlin has argued that Hegel's concept of freedom is one of a type, called by him the concept of positive freedom, which is ‘at the heart of many of the nationalist, communist, authoritarian and totalitarian creeds of our day’. It will surely be worth while to see to what extent this is true of Hegel, and to what extent Hegel's views about freedom are true. (shrink)

Dieser Aufsatz betrifft Leibniz' Gedanken über Metaphysik in der Zeit von Dezember 1675 bis Dezember 1676, d. h. von den letzten Monaten seines Parisaufenthaltcs bis zum Beginn seines Aufenthaltes in Hannover. In dieser Zeit entwarf Leibniz Pläne für eine Abhandlung über Gott und die Welt und erwog die Möglichkeit, dieser Abhandlung eine deduktive Form zu geben. Der vorliegende Aufsatz entwickit und erläutert eine vermutete deduktive Version ¿ es metaphysischen Systems, die in den verstreuten Schriften dieser Periode entdeckt werden kann. Es (...) zeigt sieht, daß viel von Leibniz' reifer Philosophie bereits in diesem System enthalten ist. Jedoch findet sich kein Hinweis auf den dynamischen Charakter der Substanz und keine klare Formulierung der These, daß jeder Substanz ein vollständiger Begriff zukommt. Man findet vielleicht einige Andeutungen der späteren These, aber diese sind eher als Vorausdeutungen auf Leibniz' spätere Philosophie zu verstehen denn als konstitutive Teile des Systems von 1675/76. At first sight, the philosophy of Spinoza may seem wholly alien to what is now generally regarded as philosophy in the English-speaking world. For some decades, the dominant trend in that philosophy has been linguistic and anti-metaphysical; the philosopher is held to be concerned with the analysis of language, and not with speculative system-building. Spinoza, on the other hand, is very much a system-builder; as to the analysis of language, he says explicitly that this is of no interest to him. (...) ‘It is not my intention’, he says, ‘to explain the meanings of words; it is my intention to explain the nature of things’. However, the paper which follows will attempt to show that Spinoza’s philosophy is not wholly without relevance today.
